I'm not sure if its game used but the jersey has been on ebay for awhile now.

So clearly other people on ebay also realize it is not used, or it would have been boughten already

NOT game used! You are correct that the MLB authentication on these have them listed as only signed jerseys. This seller has, over time, changed the wording in the description to talk about being unsure....and as-is.

Several signed all star BP jerseys were auctioned off by Hunt Auctions ending November 15, 2008. I had looked into these in the past and even contacted Hunt. They explained that they were sold in the auction as signed jerseys and nothing more (no listing or description of game used or issued from them).

Very nice research there, thank you. If, all you collect is game used, than definitely stay away. But, it's not a bad pick up if you can get in for around $200. But, it is Soto,so it's kind of a gamble as to whether he'll bounce back this year. There was a Soriano just like this, a few weeks back, that got snatched up quick. Thanks for the Hunt information, I have been looking at this since it was first listed. That helps my decision a lot.
