Perhaps it's time we took another tack and simlpy notified Mr. Manning's lawyers from the PeyBack Foundation every time we see one of these pop up.

I'm sure that they'd be interested to see his name being misused willfully for fraudulent purposes.

Greetings guys, thanks for looking out for me. Unfortunately for me I trusted in the company and didn't do adequate research before placing my bid on the jersey. I did see the great information on the site and immediately contacted the seller expressing my concern and that I would at least cover any seller expenses. For the record, I have contacted the PeyBack Foundation as well as ebay.

Did anyone contact ebay during the duration of the auction with their concerns over the authenticity of the jersey? I am interested in knowing as to whether or not they disregarded concerns on the jersey. As someone that would say that I "specialize" in calling out certain counterfeit trading cards on ebay, I get very frustrated in their refusals to remove counterfeit cards.

Again, I appreciate the communication and looking out for a fellow collector. I certainly wish that I had known about this site in advance. Hopefully this will be resolved peacefully but I am disappointed. Peyton is a standard of what is good with the game. It's sad to see something like this happen.

i wouldn't think you'd have any problems getting your money back. the auction stated that "There is a money back guarantee if the item is not as described". The item was described as "used by Peyton Manning during the 2005 season." The link I provided in my original post in this thread showed photos of manning from literally every single pre-season AND regular season game. In none of those photos is manning wearing a short-sleeved jersey as seen in the ASI auction.

an interesting sidenote is that brad started a business called "expert sports authentication" that employs bernie gernay (of PSI/pro sports investments) as an authenticator for football items. (oddily enough, they only seem to authenticate for Historic Auctions, which coincidentally is also an auction house that brad founded). anyway, brad employs bernie as a football authenticator. in this thread: http://www.gameuseduniverse.com/vb_forum/showthread.php?t=670
bernie was auctioning off a 2002 short-sleeved manning and said he was "compelled to remove the listing from eBay" due entirely to it having short sleeves. bernie also said that due to the short sleeves, he couldn't "put my name or my company name behind it". (we'll ignore the fact that bernie gernay has continued to authenticate short-sleeved mannings for Historic Auctions).

if brad's football authenticator acknowledges that short sleeves on a manning jersey are enough to justify withdrawing it from auction, then i can't imagine brad would disagree. it's a little surprising brad wasn't already aware of the issue.

have you already received the jersey? if so, was it sent via USPS?

Greetings Rudy, you're a class act and I appreciate all of your help. I'll be sure to answer all of your questions. First, I haven't paid for the jersey. I was made aware of the situation before sending any money. I have been on contact with the office but have not been able to speak to anyone other than the secretary. I explained my position and told them that I would at least pay for shipping fees and needed to know how much he was out so I could wire the money. Maybe I'll get a response tomorrow. Like I said, I explained the pictures and told them that I had been in contact with the people at the PeyBack Foundation as well for their information on the subject.

Speaking of Manning's people, they were nice enough to take the time to read and respond to my e-mail. Here was their comment on game worn jerseys:

Peyton has not/does not sell his game worn jerseys at this point.

As I mentioned earlier, I keep a close watch on the secondary market for a certain group of counterfeit tradings cards. Essentially I warn others about these cards the same way you guard others with the game used market. I've always said that sometimes sellers are unknowingly selling a fraud, so we occasionally have to give someone the benefit of the doubt. I'm confident that a peaceful resolution will be met. They have a money back guarantee that you described but I would like to think that they would want their customers to feel confident about their acquisition. I explained that they can have the best source in the world, but not having game film or a still photograph of Peyton wearing that style of jersey gives me no confidence in the jersey.

Like I said, I have all confidence that this isn't going to be a situation. I'd simply enjoy being able to get this resolved without having my ebay account either locked/suspended or something else. There's evidence to show it's not legit, there's a money back guarantee (even though I never paid), and I've offered to at least pay the seller fees. Seems like an easy situation to get through.
