    The exact termininolgy which should prove successfull if pursued in court. And it's my guess that you may make the papers with a lawyer who will do this for free in what may be a surprisingly high profile case. And ..you will obtain the item which later on will be worth more than $4,000.

        I know that this may cost money upfront, but pursue this case! This guy is a total bastard and he needs to be taught that he is not in control and that he can't do whatever he wants. Since he allowed that auction to end, he needs to abide by the law. Teach him a lesson!

            have fun trying to pursue a small claims case that involves an out of state defendant - and have fun trying to find an attorney that will take such a case without a retainer.

            the ebayer's obviously a dirtball - leave negative feedback, forget the fantasy that you actually have this bum in some sort of "binding contract" that you can actually make him live up to... and move on.

              What I would do is pay for the item with PayPal and use my credit card to pay for the item. When and if the item comes, since it will be a large package, you'll probably have to pick-it up at the post office. Open it in front of the postal clerks. If the item isn't as advertised, at least you'll have some witnesses as to what was sent. Then send it back.

              As for your money, if the item is never received or isn't as described, DO NOT go through PayPAl to get your money back. They do nothing. Go directly to the credit card company that issued the card for your refund.

              To me, you have a case but, until the item is paid for, is the contract really completed? Rick's argument would be, he NEVER paid for the item. I was willing to send it but he NEVER paid.

                Another avenue would be to go to your local FBI office. Because of the value involved and since they are looking at auction houses anyway, what can you lose?

                You can file a case and whether or not the case goes anywhere is a moot point but at least it will be on file, it won't cost you anything and, you may get some satisfaction out of the event.

                      You mentioned "filing a case." I assumed you were referring to a lawsuit, and in most courts there's a fee associated with filing a complaint. Just trying to help the guy out, so relax, chief.

                        Grandpahoo/Chief: You assumed incorrectly. The FBI INVESTIGATES possible violations of Federal laws that may or may not lead to criminal prosecution.

                        Now how does the FBI start investigations? Cases that are generated by complaints filed by person(s) and/or corporation(s). And, it doesn't cost anything to file a complaint.

                        As for a lawsuit, one would not file with the FBI - they would file in civil court and for that, there is a charge.

                        Just trying to help the guy out.

                                Man I feel for you on that...that is so unfair he is getting away with that. You win something for a good price and then they will not send it.....that really sucks.

                                For what it is worth I will never bid on any of their items.

                                What really is unfair is no matter the outcome you are going to get a negative feedback out of this....so unfair
